FACT: Lok Adalat awards are final, binding, and absolutely CANNOT be appealed. Once signed, the bank cannot reopen the loan.

Myth: "Settling fixes my CIBIL."

FACT: Settling flags your report as 'Settled', which lowers your score for up to 7 years. It is NOT a 'Closed' account.

It signals to the bank that you are absconding, triggering faster field agency escalations. Keep the SIM active.

You are not required to answer 40 calls a day. Pick up one call a week to confirm you are reachable and aware.

Secured LoansCRITICAL RISK

Home Loan

Loan Against Property (LAP)

Same SARFAESI powers. Commercial or residential property can be auctioned. Banks rarely settle unless collateral value has fallen.

Vehicle Loan

Vehicle hypothecated at RTO. Formal repossession notice required. Seized vehicles are auctioned at wholesale rates.

Gold Loan

Physical gold in bank vault. After 90-120 days default, public newspaper auction notice is published.

Settlement Reality

Banks rarely offer deep OTS haircuts on secured loans because they hold collateral as full recovery backing.

Unsecured LoansPRIMARY OTS TARGET

No collateral. Banks cannot seize your house or car. Recovery relies on civil suits, arbitration, and OTS compromises.

Personal Loan

Pure civil debt. Banks routinely approve 50% to 75% OTS waivers post-180 days default via SAMB branches.

Credit Card

High compounding interest (36%-45% p.a.). Banks actively offer 50% to 70% waivers to clear non-performing debt.

Unsecured Business Loan

Often backed by CGTMSE credit guarantee. Once classified as NPA, OTS is routinely negotiated at 50% to 70% haircut.

Settlement Reality

Recovery Caller Myths vs Legal Reality

"We have filed an FIR against you."

Reality: FALSE. Loan default is a purely civil matter. Police do not register FIRs for unpaid bank loans.

"A court warrant has been issued. Police are coming."

Reality: FALSE. Only a judicial magistrate can issue warrants after court proceedings. Agents cannot issue warrants.

"We will freeze your salary immediately."

Reality: FALSE. Salary garnishment requires a civil court decree and formal execution orders that take years.

"No OTS is possible. You must pay 100%."

Reality: FALSE. Outsources callers lie to secure maximum commissions. Senior recovery branch managers routinely approve OTS.

Calling before 8 AM or after 7 PM.

Reality: ILLEGAL. Strictly prohibited under RBI Fair Practices Code. Every late call is grounds for a formal regulatory complaint.

Calling your parents, boss, or friends.

Reality: PROHIBITED by RBI. Contacting third parties to socially humiliate you violates consumer privacy guidelines.

Can I be arrested for not paying a loan in India?+

No. Loan default is a civil matter in India, not a criminal offence. Police cannot arrest you simply because you have not repaid a bank loan. Only a court of law, after due process, can take coercive action.

What is a One-Time Settlement (OTS) on a loan?+

An OTS is an agreement where the bank accepts a lump-sum amount less than the full outstanding dues to close the loan. Banks are most open to OTS on unsecured loans (personal loans, credit cards) after the account has been classified as an NPA (90+ days default).

Can recovery agents call my family or employer about my loan?+

No. RBI guidelines strictly prohibit recovery agents from contacting your relatives, friends, or employer about your debt. Agents can only contact the borrower directly, only between 8 AM and 7 PM.

What happens to my CIBIL score if I settle a loan?+

Your CIBIL report will show the account status as "Settled" instead of "Closed". This negatively impacts your credit score and can affect your ability to get new loans for up to 7 years.

Is a legal notice from a bank the same as an FIR or arrest warrant?+

No. A legal notice from a bank is a formal written communication demanding payment. It is not an FIR, not a police complaint, and not a court order. Only a court can issue an arrest warrant, and only after proper legal proceedings.

Can a bank take my house for credit card or personal loan default?+

No. Credit cards and personal loans are unsecured loans. Banks have no collateral to seize for these. They can only pursue recovery through civil courts or arbitration, which is a lengthy process.

What is the difference between a secured and unsecured loan in terms of default?+

For secured loans (home loan, car loan, gold loan), the bank has the right to repossess and auction your collateral asset. For unsecured loans (personal loan, credit card), the bank has no asset to seize and must go through civil courts to recover money.

Can I negotiate my loan settlement directly with the bank without an agent?+

Yes, and this is strongly recommended. You can write directly to the bank's Nodal Officer or Grievance Redressal Cell requesting an OTS. Dealing directly avoids middlemen who may charge upfront fees and misrepresent your case.
